Membership Terms:

EFT Authorization: I, <CLIENTNAME>, authorize Maker13, to transfer electronic funds on a recurring basis from the checking, savings, or credit card account I specified above for my membership dues. This authorization is to remain effective until Maker13 has collected for all charges assessed regarding the terms and conditions of this Agreement.
Membership Term: I acknowledge and agree that I will maintain membership and pay the dues specified above for a minimum term of one month from <AGREEMENTDATE>. I agree that I will be liable for dues for the entire term of this agreement in the amount as stated herein regardless of usage or any change of circumstance.
• Down Payment: I am making an initial down payment of $0.00 as of <AGREEMENTDATE>.
• Next Payment: I understand my next payment for <RECURRINGPAYMENT> is due on <AGREEMENTDATE> and on the same day of each calendar month. When the term has expired, this Agreement shall automatically continue from month to month, or as applicable, until I submit the cancellation form to Maker13. I am responsible for all charges billed or incurred prior to cancellation. I further agree that my membership benefits are exclusive to me and are in no way transferable to anyone else.
Maker13 agrees to provide and the Member, <CLIENTNAME>, agrees to purchase competent instruction, supervised by qualified personnel trained in the procedures and traditions of such activities.

The Member acknowledges and agrees as follows:

1. I have chosen to enter into the following program(s) and classes: <CONTRACTNAME>
2. Maker13 or any party designated by Maker13 may photograph or film me while I attend the premises of Maker13 and use of all such photos, video footage and/or video streaming for promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet.
3. The required physical exertion of classes/use of equipment may be strenuous and cause physical injury, and I am fully aware of the risks and hazards involved. I hereby represent that I am physically fit to receive and participate in the prescribed course of instruction/use of equipment. I acknowledge that I have been advised to consult with a physician prior to and regarding my participation in the classes or use of the equipment and that my physician has confirmed to me that I have no medical condition which would affect my full participation in the classes or use of equipment.
4. All users of the facilities at Maker13 are responsible for his or her own safety. In consideration of my being permitted to participate in the classes and use of equipment, I for myself, my heirs, executors, administrators, successors, assigns and anyone else who may claim on my behalf hereby waive any and all claims, liability and damages I may now or in the future have against Maker13, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns, arising by any means whatsoever, including, but not limited to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused arising from or in connection with my participation in the classes or use of equipment, however caused.
5. I further hereby release, remiss and forever discharge Maker13 , its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from and against all demands, claims, actions, damages, costs and expenses arising from or with respect to death, injury, damages to or loss to my person or property of any kind whatsoever, no matter how caused, arising from or in connection with my participation in the classes or use of equipment whether or not caused by, in whole or in part, the negligence or gross negligence of Maker13.
6. I will hold harmless and indemnify Maker13, its directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from all liability for any damage or injury to the property or persons of any third party resulting from my involvement in or presence during any of the classes.
7. I will comply with all the rules and regulations of Maker13.
8. I will pay a service charge of $25.00 for any payments 10 days past due. If there are three payments which are 10 days past due during the period of this Agreement, I agree to pay the remaining balance of the Agreement in full, in addition to any and all recovery charges incurred.
9. I hereby agree that if Maker13, is unable to process my payment from the designated account provided by me Maker13 is permitted to use any of the other accounts information provided as many times and as often as needed to replace the unpaid payments and service charges as explained in this agreement.
10. In addition to any rights and remedies it may otherwise have, Maker13 may terminate this Agreement upon five days written notice to me if I fail to comply with my obligations under this Agreement and do not cure any such failure within five days after receiving notice of such failure.
11. Failure to attend the classes or use the equipment does not relieve me of the obligation to pay the full tuition for the class or hours in which I am currently enrolled. Further, any class not canceled prior to 24 hours to the class will not receive a refund for class fees without notification and acknowledgment from the instructor.
12. This Agreement can be canceled at the end of the contract term. Upon notification of a cancellation request, members will have an active membership until the end of the current contract term. Refunds for previous contract terms will not be honored. Classes may be removed from the record upon cancellation. Requests for cancellation must be made in person at 629 Michigan Avenue, Jeffersonville, IN, or by email at info@maker13.com. Cancellation requests are complete once Maker13 receives the completed and signed Membership Cancellation Form.
13. I confirm that the provisions in this Agreement constitute the entire agreement between the parties hereto and supersede all prior communications, proposals, representations and agreements, whether oral or written with respect to the subject matter of this Agreement.
14. Maker13 is committed to protecting the privacy of our customer’s personal information. We make every effort to ensure that the information you share with us is recorded accurately, retained securely and used only according to your wishes. We collect personal details necessary to communicate with you, and manage our ongoing business relationship with you.
15. All materials and projects stored at Maker13 by members must be labeled to include name, phone number, and projected move date. Non- or partially labeled material or projects may be removed by Maker13 staff. Maker13 is not responsible for lost or damaged member property.
16. I agree to cover the cost of the damages to the facilities, equipment, other member's property, and injury to other members due to use of the equipment. Costs may include but are not limited to loss of income to Maker13, equipment costs, facilities repairs, and labor.
17. I agree to comply with all relevant laws and regulations in his or her use of Maker13 in accordance to state and federal law. Failure to do so may result in immediate membership termination and/or legal ramifications with police authority.
18. I acknowledge receiving a copy of this Agreement.
19. I understand my rights and obligations as stated above. I confirm that I am the full age of eighteen years (unless otherwise indicated) and that I have read and understood this release and waiver of liability and I am aware that by signing this Agreement I am waiving certain legal rights, including the right to claim damages which I or my heirs, executors, administrators, successors or assigns may have against Maker13.

Maker13 Participation Rules:

The following policies are in place to ensure fair access to Maker13’s workshop and promote member safety. Failure to adhere to these policies will result in the termination of this membership contract and/or the member being responsible for equipment replacement costs and additional labor costs associated with damage to Maker13 property. Membership is not a guarantee.


Member agrees that he or she will obey the following rules:
1. Consider other members' rights and privileges.

2. Always treat members and staff with the fullest respect and courtesy at all times. Failure to do so may result in membership termination.
3. Always accept the fullest responsibility for any damage to equipment due to his or her misuse of the equipment.
4. Pay membership dues on or before the reoccurring due date of each month as set based on the membership start date - or pay a late fee (N/A if autopay is setup).
5. Check in with a Maker13 employee or representative upon arrival before using the equipment.
6. Clean up the area in use and leave it better than before its use (clean, fully assembled, in good working order).
7. Return equipment/tools to their proper place.
8. Follow directions on the proper use of the equipment and ask for directions when necessary.
9. Never use equipment that he or she has not been trained on or cleared to use.
10. Never misuse equipment.
11. Never leave equipment unwatched while in use.

12. Children under the age of 12 must not be left unsupervised while visiting the shop. If children distract from watching the equipment, neither is being done correctly.

13. Children under the age of 16 are not allowed in the wood or metalwork when machines are in use.
13. Never go over scheduled time on equipment, the member may purchase additional equipment time if applicable. (see Maker13 Equipment Rules Section)
14. Never use coarse language or make abusive comments towards others.
15. Dispose of trash in the proper places.

16. Alert a Maker13 employee or representative any the equipment is not acting or sounding normal. Failure to report an issue may result in a repair charge or injury. 
17. Never use Maker13 facilities or equipment to alter the use of, or manufacture weapons of any kind. Please ask a Maker13 employee for prop/costume weapon approval before proceeding.

Maker13 Equipment Rules:

1. Maker13 equipment is to be scheduled using the online reservation system, or by contacting a Maker13 staff member. Each equipment set may only be reserved in advance for a maximum of 4 hours total per day. (3D printers have longer reservation times due to the equipment. No more than two 3D printers may be reserved at any given time without prior staff permission) As an example; All lasers are considered 1 set of equipment. If Member needs additional equipment time, he or she may purchase an additional one hour for $10.00 only if the immediate time slot is not reserved that day after their arrival. Additional time may be purchased by non-members who have the proper training for $20.00 per hour.
2. Always wear proper eye protection and closed-toed shoes while in the wood and metal shop areas. This applies regardless of if you are working on machinery or not. Ear protection is also recommended.
3. No member, user of the workshop, or workshop attendee may use any shop equipment unless authorized to do so through successfully taking and passing the Maker13 training class.
4. Only Maker13 members are permitted in the wood and metal without prior permission and supervision.
5. Never run any materials with metal through any of the woodshop machines.
6. No wet or green wood materials of any kind may be run through any of the woodshop machines.
7. Replacement cost due to neglect by breaking Equipment Rules will be the responsibility of the individual who caused the damage.
8. No pets are allowed in any of the workshop areas.
9. Do not attempt to oil, clean, adjust or repair any machine. Please seek a Maker13 staff member. Performing maintenance on moving machinery can lead to injury or death.
10. Never open any covers, casing, or shrouds while the machine is running.
11. Ensure that all machine guarding is in place and functioning properly. It is your duty to inform a Maker13 staff member if the guarding is damaged or malfunctioning. Malfunctioning guarding will not properly protect you and becomes a hazard itself.
12. Never leave machines running unattended. Others may not notice the machine is running and be injured.
13. Do not try to stop the machine with your hands or body. Stopping the machine with your body can result in entanglement, dismemberment, or death. Always let moving parts come to a stop under their own power.
14. Always keep hands, hair, feet, etc. clear of all moving machinery at all times. All long hair must be tied back above shoulder height. Loose-fitting clothes such as baggy sweatshirts or long sleeve shirts with loose cuffs should not be worn in the shop.
15. Ask for help when moving awkward or heavy objects. This will protect you and those around you from injury.
16. Never start a conversation with someone who is using machinery. Always wait for them to complete their task before talking.
17. Never attempt to pass behind someone while they are using machinery. Always stop and wait for them to complete their task before passing.
18. Work at a pace that is comfortable for you. Rushing will compromise your safety and increases the chance of damaging equipment.
19. Listen to the machine(s) — if something does not sound right, shut it down. Often if the machine sounds abnormal to you, it likely is not operating properly. Inform Maker13 staff if you believe the machine to be operating abnormally.
20. Please clean up spilled liquids immediately to prevent slipping hazards.
21. All materials should be stored in such a way that they cannot become tripping hazards.
22. Return all excess material to its proper storage place.
23. All hazardous materials and chemicals must be properly stored in the locked cabinet at all times when not in use. Prior permissions are required to use and house such materials.

24. Proper ventilation is required for any spray adhesive or finishes.
25. All work should stop 10-15 minutes prior to the time you need to leave Maker13. This will provide ample time to clean and replace tools for the next member.
26. It is important for the safety of members to retain current knowledge of the equipment prior and during to usage. Subsequently, a member may not be allowed to use equipment, or they may be required to retake equipment classes if 6 months have passed without using the equipment.
